Advising the Authority, Management and Staff on Legal Matters

  1. Draft and review contracts and documents of a legal nature in order to minimise legal risk for the organisation, which task is ongoing;
  2. Legal Opinions and Legal Research;
  3. Manage the process of enforcement by supervising compliance of the licence conditions by licensees;
  4. Ensure regulatory and statutory compliance;
  5. To manage the licensing process in terms of reviewing applications for compliance, publications, hearings and provide advice on applications and recommendations in order to ensure that the decisions to award licences are procedurally and substantively correct where required.
  6. Advice on constitutionality and legality of administrative actions of the Authority; and
  7. To manage the tariff approval process in the form of advice on the tariff submissions and approvals, in order to ensure legality or compliance with the Act on an ongoing basis.
  8. To review and analyse the annual trend register for submission to the Board of Directors regarding consumer complaint trends for the year. This task is conducted bi-annually.

Drafting Legislation and Regulations

  1. Identify, initiate, recommend, draft and review legislation and regulations, including the Communications Act according to the Strategic Plan annually;
  2. Liaise with external legislative drafters; and
  3. Liaise with office of the Attorney General and Government Legislative Drafters.

Debt Collection

  1. Responsible for the collection of arrear licence fees and levies through outsourcing to debt collectors.
  2. Provide Legal Representation for the Authority at hearings, reconsiderations and other forums
  3. Represent the Authority at public consultative meetings, facilitate workshops and trainings as well as stakeholders engagement sessions;
  4. Represent the Authority at Court and Labour matters; and
  5. Represent the Authority at meetings with external bodies.
  6. Represent the Authority at hearings, reconsiderations and other forums in order to provide sound legal support according to all relevant Acts and Regulations, which process is ongoing.

Review communications of line departments and press releases

  1. Review all communications, circulars and press releases.

Monitoring the legislative landscape and identifying laws that have an impact on the Authority

  1. Ensure that the Authority stays abreast of any legislative changes that may have an impact on it; and
  2. Monitor changes to legislation in SADC to ensure harmonisation of laws in the region.

Innovation

  1. Keep up to date with ICT development, management, policy and regulations as well as trends.
